Sitzer settlement survives another challenge as attorneys fight over $120M commission fund

The Eighth Circuit Court of Appeals will not be rehearing appeals of the final approval of the Sitzer/Burnett commission lawsuit settlement agreement. Last week, the appeals court denied requests to rehear the appeal by objectors Monty March and Robert Friedman. Friedman also filed a rehearing petition regarding the appeals court’s decision to uphold the final approval of the Gibson commission lawsuit settlement in mid-September. The court has yet to rule on this petition. Both the Sitzer/Burnett and Gibson settlements were upheld by the appeals court late this summer. In an emailed statement a spokesperson for the National Association of Realtors (NAR) that the trade group was “pleased with the Eighth Circuit Court of Appeals’ decision to deny the rehearing petitions.” “We remain confident that the Court correctly affirmed the settlement approval, and we will continue working to foster fair, transparent, and pro-consumer real estate markets while providing resources and value to our Realtor members nationwide,” the spokesperson added.
